Cyclist sues driver after Swansea collision

A man has filed suit against the driver who he claims struck the bicycle on which he was riding.

Thomas Little claims he was crossing North Illinois Street near its intersection with Old Fullerton Road in Swansea on Jan. 16, 2013, at about 8:02 p.m. when defendant Dana L. Fitch, who was driving a 2010 Ford Fusion north on North Illinois Street, struck his bicycle.

Because of the collision, Little was severely and permanently injured, suffered physical and mental pain and anguish and incurred medical costs, the suit filed Jan. 13 in St. Clair County Circuit Court states.

Fitch negligently failed to keep her vehicle under proper control, failed to keep a proper lookout, failed to stop or take other evasive measures to avoid a collision, drove too fast and drove without safe brakes, the complaint says.

In addition to Dana Fitch, Little names John Fitch as a defendant, saying he negligently allowed Dana Fitch to drive his vehicle, failed to deny her from use of his vehicle when he knew that she was an incompetent driver and entrusted his vehicle to her when he knew of unsafe conditions, the suit states.

In his complaint, Little is seeking a judgment of more than $150,000, plus costs.
