A man has filed suit against the driver whom he alleges struck him as he was walking to his vehicle.
J. Bunyan Zeller alleges he was walking to his vehicle in a parking lot at 1900 East Edwardsville Road in Wood River on Jan. 10, 2013, when defendant Amos Eugene Overton struck him from behind.
Because of the collision, Zeller sustained injuries to his elbow, knee and ankle, incurred disability and lost wages and his normal life, according to the complaint filed Jan. 8 in Madison County Circuit Court.
Overton negligently failed to reduce his speed, failed to keep a proper lookout, failed to warn of his impending approach, failed to see Zeller when he should have been seen and failed to stop to avoid a collision, the suit states.
Attorney Michael J. Hertz, of Lucco, Brown, Threlkeld and Dawson in Edwardsville, will represent Zeller.
