Passenger claims she suffered vision distortion as a result of accident

A woman has filed suit against the driver who she claims struck the vehicle in which she was riding.

Donja Small claims she was riding in a 2002 Chevy Venture on Dec. 12, 2012, when defendant Robert W. Smith, who was driving a 2012 Chrysler 300, attempted to make a turn onto Fairview Road and struck her vehicle.

Because of the collision, Small suffered severe neck and back pain, migraines, blacked out, vision distortion and memory and neurological issues and endured extreme pain and suffering, according to the complaint filed Dec. 11 in Madison County Circuit Court.

She also lost wages, incurred medical costs and experienced an increased risk of additional future medical costs, the suit states.

Small blames Smith for causing the collision, saying he negligently violated the traffic signal, drove too fast, failed to keep a careful lookout, failed to signal an intention to turn and failed to yield the right-of-way.

In her complaint, Small is seeking a judgment of more than $50,000, plus costs and other relief the court deems just.
