Nursing home seeks foreclosure on man's home citing failure to pay for wife's care

A nursing home filed suit against the husband of a resident that it alleges failed to pay more than $150,000 for his deceased wife's care.

Community Care Center of Mascoutah doing business as Mar-Ka Nursing Home filed a lawsuit Dec. 8 in St. Clair County Circuit Court against Burl Cason.

In its complaint, Mar-Ka says Burl Cason owes $150,273.83 for care and services provided to Eileen Cason, who was living at the nursing home.

"Defendant Burl Cason's failure to pay the amount due and owing is a material breach of his agreement with CCCM," the suit states.

In addition to the money it alleges it is owed, the nursing home seeks pre- and post-judgment interest, attorney fees, costs and other relief the court deems just. It also seeks a foreclosure on Burl Cason's home at 1304 Leona Drive in Fairview Heights.

Attorney Joel A. Kunin, of The Kunin Law Offices in Collinsville, will represent the nursing home.
