An Edwardsville couple alleges a vinyl siding manufacturer refuses to replace their home's siding after it began fading following installation.
Ronald and Lisa Long filed a lawsuit Dec. 1 in Madison County Circuit Court against CertainTeed Corporation.
In their complaint, the Longs say they purchased Owens Corning vinyl siding for their home at 4 Fox Trail Court in Edwardsville in 2000. The siding came with a lifetime warranty that covered blistering, cracks, corrosion, flakes and peeling, according to the complaint.
In March 2012, the Longs began to notice that the siding was fading and corroding, the suit states. In turn, they notified defendant CertainTeed and demanded that the company replace the siding, the complaint says. CertainTeed had acquired Owens Corning, the Longs say
However, CertainTeed rejected the Longs' claim, according to the complaint, and the Longs face costs of more than $25,000 to replace the siding.
"Defendant breached the lifetime warranty by rejecting plaintiffs' claims, causing plaintiffs to sustain damages in excess of $40,000," the complaint says.
In their complaint, the Longs seek a judgment of $40,000, plus compensatory damages of $40,000, attorney fees of $20,000, punitive damages of more than $250,000 and costs.
