O'Fallon pedestrian's death is subject of suit

The administrator of a deceased woman's estate has filed suit against the driver whom he alleges struck the woman, causing her death.

William Henggeler alleges he and Patricia Henggeler were walking in the intersection of East Highway 50 and South Hilgard in O'Fallon on Sept. 14, 2013, when defendant Gwendolyn Butler, who was driving through the intersection, struck Patricia Henggeler.

Because of the incident, Patricia Henggeler died and her next-of-kin lost her society, companionship, support, love and affection, according to the complaint filed Dec. 1 in St. Clair County Circuit Court. They also experienced grief and sorrow, the suit states.

Butler negligently failed to yield at an intersection, failed to keep a proper lookout, failed to keep her vehicle under proper control and drove too fast, the complaint says.

William Henggeler seeks a judgment of more than $100,000, plus costs. He is represented by attorney Bruce R. Cook of Cook, Ysursa, Bartholomew, Brauer and Shevlin in Belleville.
