A Roxana man has filed suit against the driver whom he alleges struck his vehicle, causing him to sustain injuries.
James Perry alleges he was driving a 1999 Ford F-250 on the 100 block of Illinois Avenue when defendant Faye Carter pulled out of her private driveway at 102 Illinois Ave. in South Roxana and struck Perry's vehicle.
Because of the collision, Perry suffered low back pain, back spasms, whiplash, tailbone bruising and neck pain and incurred property damages, according to the complaint filed Nov. 26 in Madison County Circuit Court. He also incurred medical costs, lost wages and lost his normal life, the suit states.
Carter negligently failed to keep a proper lookout for oncoming traffic, failed to yield the right-of-way, failed to properly emerge from a private driveway, failed to reduce his speed to avoid an accident and failed to give a proper warning, the complaint says. He also failed to yield the right-of-way, failed to properly emerge from a private driveway and failed to reduce his speed to avoid a collision, the suit states.
Perry seeks a judgment of more than $50,000, plus costs.
