A woman has filed suit against the Domino's Pizza delivery driver whom she alleges disobeyed a stop sign and struck her vehicle.
Dana Gabriel alleges she was driving her 2004 Pontiac Montana east on Hillcrest Avenue at its intersection with Rixon Street in Alton on June 19 at 3:17 p.m. when defendant Phillipp Jackson, who was driving south on Rixon, failed to yield at a stop sign and struck her vehicle.
Because of the collision, Gabriel, sustained temporary and permanent injuries, incurred medical costs and was prevented from attending her usual duties, according to the complaint filed Nov. 26 in Madison County Circuit Court.
Jackson negligently failed to keep a proper lookout, drove too fast, failed to exercise proper control, failed to brake, failed to yield the right-of-way and failed to obey a stop sign, the suit states.
In her complaint, Gabriel seeks a judgment of more than $100,000, plus costs.
Attorney Shawn Lintz, of The Lintz Law Firm in Alton, is representing Gabriel.
