Driver exiting Wendy's caused collision, suit says

A woman has filed suit against the driver whom she alleges struck her vehicle while the driver was attempting to exit a Wendy's parking lot.

Ann M. Ernst filed a lawsuit Nov. 19 in St. Clair County Circuit Court against Sarah E. Rieso.

In her complaint, Ernst alleges she was driving north in the inner, northbound lane of state Route 159 in Fairview Heights on Dec. 1, 2012, at about 3:35 p.m. when Rieso, who was driving west in the parking lot of a Wendy's restaurant, attempted to turn left and proceed south on Route 159. As Rieso was pulling out of the parking lot, she struck Ernst's vehicle, according to the complaint.

Because of the accident, Ernst suffered serious and permanent injuries to her head, neck, chest, legs, ankles and feet and incurred medical costs, the suit states. She also suffered disability, disfigurement and pain and lost her normal life, the complaint says.

Ernst blames Rieso for causing the collision, saying she negligently failed to yield the right-of-way, failed to reduce her speed to avoid a collision, drove too fast, failed to keep a proper lookout and failed to maintain proper control of her vehicle.

In her complaint, Ernst seeks compensatory damages of more than $50,000, plus costs.

Attorney Edward J. Szewczyk, of Callis, Papa and Szewczyk in Granite City, will represent Ernst.
