Passenger says driver hit rock pile, became airborne and struck concrete pipes

A man has filed suit against the driver whom he alleges struck a rock pile, became airborne, then struck concrete pipes.

Kory M. Crawford alleges defendant Brandy Garcia was driving a 1999 Pontiac Grand Am in which he was a passenger on Montclair Avenue at its intersection with Godfrey Road in Madison County on Nov. 25, 2012.

"The defendant negligently drove the vehicle she was operating in such a manner that it struck a rock pile, became airborne and struck concrete pipes at the above-referenced intersection," states the suit filed Nov. 14 in Madison County Circuit Court.

Because of the collision, Crawford suffered serious and permanent injuries, incurred medical costs and lost money, the complaint says.

Crawford blames Garcia for causing the collision, saying she negligently failed to keep her vehicle under proper control, failed to stop to avoid a collision, failed to keep a proper lookout and failed to observe the speed limit and traffic control devices.

In his complaint, Crawford seeks a judgment of more than $50,000, plus costs and other relief the court deems just.

Attorneys Edward W. Unsell and Fred Patrick Schuman, of East Alton, will represent Crawford.

Madison County Circuit Court case number: 14-L-1552.
