Recycling company files lawsuit against former employee who allegedly violated contract

Totall Metal Recycling has filed suit against one of its former employees, alleging she violated numerous contracts after she left employment with the company

In its complaint, Totall, of Granite City, alleges it hired defendant Lynn Fix to serve as freight broker on its behalf on Oct. 31, 2005. On March 14, 2014, Fix submitted her resignation, according to the complaint filed Oct. 22 in Madison County Circuit Court.

Before leaving her employment, Fix gathered confidential contact information regarding Totall's customers and suppliers, plus other confidential information, that she disclosed to Totall's business competitors, the suit states.

In its complaint, Totall alleges breach of contract against Fix, saying she agreed to refrain from revealing confidential information when she began her employment with Totall.

Totall seeks a permanent injunction that would prohibit Fix from violating the agreement, plus a modification to the agreement to enforce provisions in it. It also seeks a judgment of more than $50,000, attorney fees, costs and other relief the court deems just.

Attorney Brian D. Flynn, of Flynn, Guymon and Garavalia in Belleville, will representing Totall.
