A Madison County couple is suing the makers of a synthetic mesh that allegedly failed after being used to repair the man's hernia.
Clifton and Jean Dellamano filed a lawsuit Oct. 10 in Madison County Circuit Court against C.R. Bard Inc., Davol Inc., Dr. Morris Kugler and Southern Illinois Surgical Consultants SC.
According to the complaint, Clifton Dellamano underwent hernia surgery in April 2009 at Anderson Hospital in Maryville. Dellamano says Dr. Kugler, a member of Southern Illinois Surgical Consultants, performed the procedure. During the operation, Dr. Kugler allegedly used a synthetic mesh made by Bard and Davol and known as Bard Marlex Mesh to help close the abdominal wound.
In November 2012, Dellamano claims he had to have a second surgery at the initial hernia spot because the grafted mesh had disintegrated, causing a recurrence of the hernia. The damage caused by the mesh allegedly left the abdominal wall unable to be properly repaired.
The Dellamanos accuse the defendants of negligence for making, selling and using a product the surgeons knew or should have known to be defective. They ask for more than $400,000 in damages for medical expenses, loss of income and court fees.
