Woman accuses Alton casino of negligence after fall on bathroom floor

Cynthia Austin filed a lawsuit against Argosy Casino LLC on Oct. 3 in Madison County Circuit Court.

Austin was at the Argosy Casino in Alton on Oct. 19, 2012 when, according to the complaint, she was hurt. She says it was at about 10 p.m. when she walked into the first floor bathroom and "slipped and fell violently on the wet floor."

Austin contends she had no reason to believe the floor would be slippery and had no time to discover the dangerous condition prior to the fall.

Austion, who was 39 years old at the time, says she fractured teeth and suffered thoracic, lumbar and cervical sprains as a result of the fall. She accuses the Argosy Casino of negligence, vicarious liability and negligent hiring and/or retention for allegedly allowing the bathroom floor to become unsafe and failing to warn patrons of the danger.

Marvin asks to be awarded more than $75,000 in damages. Attorney Reginald A. Greene with the Greene Legal Group in Atlanta, Ga. represents her. They demand a jury trial.

Madison County Circuit Court case number: 14-L-1353.
