St. Clair County insurance company asks uninsured driver to pay $106,000

A St. Clair County insurance company is asking to be reimbursed for a claim it allegedly paid for a crash involving an uninsured driver.

Progressive Northern Insurance Co., as subrogee of Jarrod Fitzpatrick, filed a lawsuit Sept. 22 in St. Clair County Circuit Court against David Sunde.

According to the complaint, Fitzpatrick was driving on Plainfield Road in Crest Hill in Will County in August 2012. Near the intersection of Caton Farm Road, Sunde, driving the other direction on Plainfield Road, allegedly crossed the center line and crashed into the front of Fitzpatrick's car.

Progressive Northern contends it provided insurance to Fitzpatrick with a provision covering uninsured or underinsured motorists. The company claims that because Sunde was not insured, it was forced to pay more than $106,000 to Fitzpatrick to cover damages from the crash.

Progressive Northern accuses Sunde of negligence and asks to be awarded what it paid to Fitzpatrick plus costs of the lawsuit. Attorney Claire M. Connolly, of Chicago, represents the insurance company.
