Plaintiff claims alleged attacker mistook his identity

A negligence claim was filed against a man accused of causing an altercation at an Alton business.

Dan Boyce filed a lawsuit against Sherman LaMere on Sept. 8 in Madison County Circuit Court.

According to the complaint, Boyce was at 2505 State St., Alton, when "without provocation and knowledge as to what was about to happen," he was injured by LaMere. The lawsuit does not provide details about the chain of events but accuses LaMere of using "excessive force under the circumstances" and being "mistaken about the identify of the plaintiff."

Boyce says he received injuries to his body that required him to seek medical care. He accuses LaMere of negligence and seeks more than $50,000 for medical expenses, disability and loss of normal life activities.
