Scrapping company accused of failing to pay business associate

A company is accused of owing more than $106,000 for a railroad car scrapping venture.

John Johnson Joint Venture filed a lawsuit against Riverbend Scrap Corporation of Brighton on Sept. 2 in Madison County Circuit Court.

John Johnson Joint Venture entered into a series of contracts in 2013 with Riverbend Scrap Corporation for the scrapping of railroad cars, according to the complaint. John Johnson says it has performed all requirements set out in the contracts but says the defendant has not.

John Johnson contends Riverbend Scrap owes $106,370 in principal plus $5,052 in interest through July 27. The debt is subject to interest of 4.25 percent per year, the lawsuit reads.

The defendant allegedly has refused to pay the amount owed, despite repeated demands. John Johnson seeks more than $100,000 for the amount owed plus interest, attorney fees and court costs.

Attorney Donald K. Schoemaker of Greensfelder, Hemker & Gale in Belleville represents John Johnson Joint Venture.

Madison County Circuit Court case number: 14-L-1197.
