A material provider has filed suit against the trucking company that it alleges failed to pay for services.
Columbia Quarry Company of Dupo alleges it contracted with Petroff Trucking of Granite City in which it agreed to perform work for an IDOT job on Interstate Highways 55/70 in Illinois. Although Columbia Quarry Company performed all work expected of it, Petroff has failed to pay for it, according to the complaint filed Aug. 26 in St. Clair County Circuit Court.
"The total amount due for the past due invoices is $122,983.77," the suit states. "While the amount due for attorney fees and costs will be supplied at a later date in the form of an affidavit, the finance charges due by Petroff to CQC for the past due invoices as of this date totals $31,869.46."
The suit alleges Petroff owes Columbia $154,853.23 for materials that it provided.
In addition to Petroff, CQC names Mobile Aire Transport Service as a defendant, saying it also failed to pay $954.60 for past due invoices, plus $480.72 for finance charges.
In addition to the money, CQC is seeking attorney fees, costs and other relief the court deems just.
Troy A. Bozarth and Andrew K. Carruthers of HeplerBroom in Edwardsville will represent Columbia Quarry.
The case number is St. Clair County Circuit Court case 14-L-610.
