A man has filed suit against a driver he claims drove away while he was reaching into the back of the vehicle to care for his children.
Nicholas Antonovich filed suit Aug. 15 in the Madison County Circuit Court against Marla Miller.
According to the complaint, the plaintiff was reaching into the back of defendant Miller's vehicle on Oct. 28, 2012. The vehicle was parked at 1318 Madison Ave. in Madison, according to the complaint.
As Antonovich attempted to attend to his children, who were sitting in the backseat of Miller's vehicle, Miller pulled the automobile forward, the suit states. As a result of the incident, Antonovich sustained physical injuries, incurred medical costs, lost wages, suffered disfigurement and disability and was restricted in pursuing his usual activities, the complaint says.
Antonovich blames Miller for causing his injuries saying she negligently failed to keep a proper lookout, allowed her vehicle to collide with Antonovich's, drove too fast, failed to reduce her speed, failed to control her vehicle, drove in a careless manner and failed to warn him that she was leaving.
Antonovich seeks a judgment of more than $200,000, plus costs and other relief the court deems just. He is being represented by attorney George H. Albers of Roth Law Offices in Granite City.
