A couple is suing a construction company because their patios are failing on their new home.
David and Cynthia Horace filed a lawsuit Aug. 7 in the St. Clair County Circuit Court against Avalon Construction Ltd., citing beach of contract.
The Horaces contracted with the company in 2011 to build their home in Millstadt. They informed Avalon the front and back porches were failing with "blisters" in the concrete. An independent consultant said the problems were caused by an substandard aggregate in the concrete. The Horaces demanded Avalon tear out the concrete and redo the work, but Avalon has not done the work, the suit states.
The Horaces are seeking in excess of $50,000 in damages. They are represented by attorney Donald Schoemaker of Belleville.
