Allstate and driver sued over I-64 accident

A St. Louis man is suing over claims he was injured in a collision with an uninsured driver on Interstate 64 and has not been compensated by his insurance company.

James Robert McCullen filed a lawsuit July 31 in the St. Clair County Circuit Court against Heather M. Thomas and Allstate Insurance Co., citing negligence.

According to the complaint, McCullen was driving on Interstate 64 on Aug. 1, 2012, when his vehicle was struck by Thomas, an uninsured driver. McCullen says he sustained injuries to his neck, shoulders, back and spine, which required rehabilitation services. The complaint states McCullen was insured by Allstate at the time of the collision, including coverage for damages caused by an uninsured driver, for which he has not been paid.

McCullen is seeking more than $50,000 in damages from Thomas and $100,000 from Allstate. He is being represented in the case by attorney Noel A. Sevastianos of Sevastianos & Associates P.C. in St. Louis.
