Village of Roxana says plaintiff has failed to produce answers

The Village of Roxana says that a plaintiff in a personal injury suit has failed to answer interrogatories and respond to requests for production.

Ashton Luck sued the Village in March claiming police officers stepped on her hand during a 2013 raid conducted to apprehend a criminal. Luck was not the suspect but claims officers ordered her to stay on the ground and stepped on her extended right hand.

The Village, represented by Charles Pierce of Belleville, denies Luck's allegations and further claims that she has failed to file answers to interrogatories.

"This defendant cannot prepare its case without the completion of said discovery," Pierce wrote last month.

Luck, represented by Samuel Mormino, Jr. of Alton, claims officers failed to conduct the arrest in a safe manner, failed to control bodily movements and failed to keep a proper lookout for bystanders during an arrest.

Luck seeks a judgment of more than $100,000.

Circuit Judge Barbara Crowder presides over the case.
