Shop 'N Save sued by ice delivery man over trip and fall

A Missouri man is suing over claims he was injured at a Shop 'N Save while making an ice delivery.

Jonathan Koch filed a lawsuit Aug. 1 in the Madison County Circuit Court against Shop 'N Save Warehouse Foods Inc., Supervalu Inc., doing business as Shop 'N Save, and Jane Doe, citing premises liability.

According to the complaint, Koch was an employee of Arctic Ice, insured by Netherlands Insurance Company, on Aug. 4, 2012, when he made a delivery of ice which a Shop 'N Save employee required him to meet at the "frozen" dock with a manual pallet jack instead of the safer receiving dock and encouraged him to "hurry."

Koch says he tripped on the height difference between the dock and his truck and sustained injuries. Shop 'N Save and Supervalu are accused of premises liability and vicarious liability, and the employee is accused of negligence.

Koch is seeking more than $50,000 in damages. He is being represented in the case by attorney Nicholas A. Loyal of Nielsen, Zehe & Antas P.C. in Chicago.
