Non-profit files legal malpractice suit over alleged failure to tell insurer about discrimination suit

A St. Clair non-profit is suing over claims its attorney failed to inform its insurance company of lawsuit defense costs, causing the insurance company to deny a claim.

Comprehensive Behavioral Health Center of St. Clair County Inc. filed a lawsuit July 23 in the Madison County Circuit Court against John Gilbert and Hinshaw & Culbertson LLP, citing legal malpractice.

According to the complaint, Comprehensive Behavioral Health was charged with discrimination by a former employee in 2010, and the documents were given to the company's employment and labor attorney, Gilbert. The complaint states Gilbert failed to inform the plaintiff's insurance carrier of the settlement proposal until 2012, causing Great American to deny the plaintiff coverage for the cost of defending against the discrimination charges.

Comprehensive Behavioral Health is seeking more than $50,000 in damages. It is being represented in the case by attorney George R. Ripplinger of Ripplinger & Zimmer LLC in Belleville.
