A St. Clair County company is suing over claims it was defrauded into purchasing thousands of golf GPS units.
Metro Golf Inc. filed a lawsuit July 29 in the St. Clair County Circuit Court against Skyhawke Technologies LLC, citing breach of contract.
According to the complaint, Metro Golf entered into an agreement with Skyhawke in September 2009, where Metro Golf would purchase 3,924 Skycaddie SG3 GPS units from Skyhawke for $431,943 and in return would get to administer Skyhawke's "trade up/trade in" program. Metro Golf says it subsequently found out Skyhawke had given the program to another company.
Metro Golf attempted to return the GPS units, and in March 2010, an agreement was reached whereby Metro Golf would sell the units to Golfsmith International at a loss, and Skyhawke would pay Metro Golf to make up the loss. Metro Golf says it has performed the transaction with Golfsmith International but has not received the $66,600 due from Skyhawke to make up the loss. Skyhawke is accused of breach of contract, fraud, negligent misrepresentation and promissory estoppel.
Metro Golf is seeking the $66,600 owed plus interest and costs of litigation. It is being represented in the case by attorney Hrant "Hud" Norsigian Jr. of Norsigian Law Office LLC in O'Fallon.
