Motorcyclist sues Toyota claiming its driver hit him with E-250 Ford

A motorcyclist has filed suit against the driver he claims struck his vehicle.

Dale Lamm filed suit July 16 in the Madison County Circuit Court against Toyota Industries North America Inc. and Keith Wyvell.

According to the complaint, Lamm was driving his 1982 Yamaha motorcycle east on U.S. Route 40 on July 19, 2013, when defendant Wyvell, who was driving a 2011 E-250 Ford north on Lake Road for defendant Toyota, failed to yield the right-of-way and struck his motorcycle.

Because of the incident, Lamm suffered permanent and disabling injuries to his head, neck, back, chest, ribs, hips and legs and endured great physical pain and suffering, according to the complaint. He also incurred medical costs, the suit states.

Wyvell negligently failed to yield the right-of-way at an intersection, failed to keep a proper lookout, failed to slow down or stop to avoid the collision and drove so as to strike the side of Lamm’s vehicle, the complaint says.

Lamm is seeking a judgment of more than $100,000, plus costs. He will be represented by Matthew R. Chapman of Becker, Schroader and Chapman in Granite City.
