Two Madison County residents allege two others have failed to repay various loans worth tens of thousands of dollars.
Francisco C. Tejada and Victorina A. Tejada filed a lawsuit July 9 in the Madison County Circuit Court against Robert A. Tejada and Ruth A. Tejada.
In their complaint, the plaintiffs allege they lent the defendants $93,324.15 on Sept. 15, 2009, an additional $24,887.58 on July 1, 2008, $19,000 on April 27, 2008, and made a mortgage note for $50,000 on Jan. 15, 2002.
The defendants also leased property at 14 Briarcliffe Drive in Collinsville on April 5, 2010, from the plaintiffs. They agreed to pay $500 every month in rent payments, according to the complaint. However, the defendants have failed to make their monthly rent payments and now owe the plaintiffs $4,338, the suit states.
The defendants also failed to fulfill the terms of the loan agreements and continue to refuse to pay the amounts they owe, the complaint says.
The plaintiffs seek the money they claim they are owed, plus attorney’s fees, costs, immediate possession of the property and other relief the court deems just.
They are being represented by attorneys Todd W. Sivia and Paul A. Marks of Sivia Business and Legal Services in Edwardsville.
