Passenger sues over Godfrey accident

A man is suing after allegedly being injured as a passenger in a vehicle.

Timothy M. Spraggs filed suit June 18 in Madison County Circuit Court against Nicholas B. Boswell.

According to the complaint, on June 28, 2012, Spraggs was a passenger in a vehicle traveling southbound on Humbert Road near its intersection with Alicia Drive in Godfrey. At the same time a vehicle driven by Boswell was traveling in the same direction when it collided with the vehicle Spraggs was a passenger in, the suit states.

The defendant is accused of failing to stop or swerve his vehicle to avoid a collision, driving his vehicle without keeping it under sufficient control, driving his vehicle at a speed greater than was reasonable, failing to keep adequate lookout, failing to reduce speed to avoid a collision and endangering the community by text messaging while operating a vehicle.

Spraggs is seeking damages in excess of $50,000, plus costs. He is represented by Fairview Heights attorney Kenneth Beljanski of Brown & Brown LLP.
