Alleged flaw in sidewalk leads to injury lawsuit against Granite City

A woman is suing after she was allegedly injured on a sidewalk in Granite City.

Wanda L. Carmack and Donald Carmack filed suit June 17 in Madison County Circuit Court against the city of Granite City.

According to the complaint, on June 28, 2013, Wanda Carmack was walking on a sidewalk owned by the defendant at O'Hare and Erin streets that was covered in grass and hid an elevation difference between slabs of more than two inches, which caused the plaintiff to trip and fall and become injured.

The defendant is accused of allowing grass to grow which hid the difference in elevation, failure to eliminate the height differences, ignoring prior complaints about the condition of the sidewalk and failure to mark the area with signs warning pedestrians.

The Carmacks are seeking damages in excess of $50,000, plus costs. They are represented by East Alton attorney Gregory M. Tobin of Pratt & Tobin PC.
