Passenger blames injuries in collision on allegedly intoxicated driver

A man has filed suit against the driver he claims caused a collision, injuring him.

Gerald M. Scaturro filed suit June 9 in the Madison County Circuit Court against Matthew J. Vogel and Jody W. Padgett.

According to the complaint, Scaturro he was riding in a 2002 Chevrolet Cavalier defendant Vogel was driving south on State Street in Alton on Jan. 1, 2013. The allegedly intoxicated Vogel suddenly crossed the center line of the highway and drove into northbound traffic, causing a collision with defendant Padgett’s 2010 Ford Taurus, according to the complaint.

As a result, Scaturro was hindered from attending to his usual affairs, lost value of his time and suffered great pain and anguish, the suit states. He also incurred medical costs, lost income, suffered disability and was prevented from attending to his ordinary life affairs, the complaint says.

Scaturro blames Vogel for causing the collision, saying he negligently drove across the center line, drove too fast, failed to decrease his speed, failed to keep a proper lookout, failed to maintain proper management and drove under the influence of alcohol or other drugs.

Padgett is also named as a defendant. She negligently drove too fast, failed to decrease her speed to avoid a collision and failed to keep a proper lookout, according to the complaint.

Scaturro is seeking a judgment of more than $100,000, plus costs and other relief the court deems just. He is being represented by Christopher R. Mendenhall and Steven W. Selby of Smith, Mendenhall, Selby and Cole in Alton.
