City of Alton, homeowners sued over raised sidewalk

A man has filed suit against the city of Alton and two of the city’s residents, alleging he sustained injuries when he fell on a cracked and raised sidewalk.

Clinton Smith filed suit June 2 in the Madison County Circuit Court against the city of Alton, Patrick Halliday and Candice Halliday.

According to the complaint, Smith was walking on an Alton sidewalk in front of a house at 2118 State St. on June 9, 2013, when he fell. There were large trees adjacent to the area of the sidewalk where the plaintiff fell that, with other factors, caused cracks and raised portions of concrete creating unevenness on the sidewalk at the aforesaid location, the suit states.

Because of his fall, Smith sustained severe and debilitating hand, knee and head injuries, according to the complaint.

Smith blames the defendants, who owned the residence in front of the sidewalk, for contributing to his fall, saying they negligently failed to inspect the area where he fell, failed to barricade or block off access to the area and failed to warn of the dangerous condition.

Smith is seeking a judgment of more than $100,000, plus costs. He will be represented by Michael J. Sudekum of Mandel and Mandel in St. Louis.
