A woman has filed suit against the store where she claims she was shopping when she fell on a liquid.
Anna Schoendienst filed suit May 27 in the St. Clair County Circuit Court against Casey’s General Stores Inc. and The Home City Ice Company.
According to the complaint, Schoendienst was shopping at defendant Casey’s General Store at 504 Hartman Lane in O’Fallon on June 26, 2012, when she slipped and fell on a fluid on the floor.
Due to the incident, Schoendienst sustained severe and permanent back injuries, experienced great pain and suffering and incurred medical costs, according to the complaint.
Casey’s employees negligently failed to remove the liquid from the floor and failed to warn of the liquid, the suit states.
Home City Ice Company sold and distributed ice to various stores, including Casey’s, the complaint says. Its employees caused the liquid on which Schoendienst slipped to accumulate on the floor, failed to remove it and failed to warn of it, Schoendienst claims.
Schoendienst is seeking a judgment of more than $100,000, but no more than $150,000, plus costs. She will be represented by Matthew R. Chapman of Becker, Schroader and Chapman in Granite City.
St. Clair County Circuit Court case number 14-L-348.
