Midwest Rehabilitation and Respiratory Center sued over resident's death

The family of a deceased man says a rehabilitation center caused the man’s death when employees neglected care of him, leading to malnourishment and dehydration.

Paul Miller filed a lawsuit May 20 in the St. Clair County Circuit Court against Midwest Rehabilitation and Respiratory Center.

In his complaint, Paul alleges Timothy Miller was living at Midwest Rehabilitation Clinic and Respiratory Center in Belleville when he died May 12, 2013.

Paul Miller blames Timothy’s death on employees’ failure to provide him with the necessary care and services to treat him and failed to provide him with restorative and rehabilitative measures. Employees also allegedly failed to assist Timothy Miller with his abilities in daily living, failed to assess changes in his condition, failed to provide him with an adequate diet, failed to protect him from abuse and failed to ensure that he received daily personal attention with regards to his personal hygiene, according to the complaint.

Timothy Miller lost his life due to neglect, dehydration and malnutrition, the suit states.

Paul Miller is seeking a judgment of more than $150,000, plus attorneys’ fees and costs. He is being represented by Grey Chatham Jr. of Belleville.
