Granite City accident blamed on cell phone-using driver

A man has filed suit against the driver he claims failed to yield while the vehicle he was riding in attempted to turn around.

Ricky L. Cox II filed suit May 22 in the Madison County Circuit Court against Christine D. Henderson.

According to the complaint, Cox was riding in a vehicle traveling west in the 3100 block of Fehling Road in Granite City on May 15, 2013, when the driver of the vehicle pulled into a driveway at 3133 Fehling Road. The driver was attempting to turn around and was backing out of the driveway, when she observed another vehicle approaching hers.

She stopped the car, but the defendant, who was approaching it, struck the vehicle while using her cell phone, according to the complaint.

Because of the collision, Cox became sick, sore, lame and disordered, suffered great physical pain and mental anguish and incurred medical costs, the suit states. He also lost wages, the complaint says.

Cox blames Henderson for causing the collision, saying she negligently failed to keep a proper lookout, failed to see the vehicle in which Cox was riding, failed to keep her vehicle under proper control, failed to apply her brakes, failed to stop or swerve to avoid a collision and drove too fast.

Cox is seeking a judgment of more than $50,000, plus costs. He will be represented by William J. Mateyka of Granite City.
