Madison County man, others named in breach of lease claim

A Madison County man and others are named in a breach of lease claim after allegedly refusing to pay rent for a gas station.

Gurdeep K. Padda, as trustee of the Irrevocable Trust of Gurdeep K. Padda, filed a lawsuit May 7 in the Madison County Circuit Court against Shashindra Khadka, Kul-D LLC, Pranita Sharma, KS and SK Enterprise Inc., citing forceable entry and detainer, breach of agreement and breach of lease.

The plaintiff claims he entered into an agreement with the defendants to lease the property he owns at 913 Edwardsville Road in Troy on Jan. 27, 2010. The suit alleges the tenants failed to pay rent due on Dec. 1 and each month after have refused to pay rent. As of May 6 they owe $35,250, according to the complaint.

According to the brief complaint, the plaintiff loaned defendant Khadka $74,813.90 to enable Khadka to operate the gas station and convenience store on the premise, and he has allegedly failed to pay any part of the loan as agreed upon. The defendants entered into a lease agreement with the plaintiff on Sept. 22, 2009, and they have failed to pay rent due Jan. 1, 2010, and each month after, causing Padda damages in the amount of $19,400, the suit claims.

Padda is seeking judgement in the amount of $131,263.90, interest and court costs. The plaintiff is being represented by attorney Teri L. Havron of Goldenberg Heller Antognoli and Rowland P.C.
