Concrete chute construction accident is subject of suit

 

The administrator of a deceased man’s estate has filed suit against the manufacturer of certain construction equipment, saying the deceased man sustained injuries when a concrete chute collapsed on top of the man.

Frederick Isenberg, as administrator of the estate of John F. Isenberg, deceased, filed suit April 30 in the St. Clair County Circuit Court against McNeilus Companies and Red-E-Mix.

According to the complaint, John Isenberg was working as a laborer on a construction project at the intersection of Interstate 55/70 and Illinois Route 162 in Troy on June 18, 2012, when he was assigned to operate a concrete chute. The chute was attached to a mixer manufactured by the defendants, according to the complaint.

“During the course of placing concrete on the aforementioned project, the concrete chutes broke free from the concrete mixer, crashing into John F. Isenberg’s person, violently knocking him to the ground,” the suit states.

Because of the incident, John F. Isenberg suffered severe injuries to his hip, neck, back and shoulder and was severely and permanently disabled and disfigured, the complaint says. Frederick Isenberg claims John F. Isenberg also incurred medical costs, experienced great physical pain and mental anguish and lost wages because of his inability to pursue his normal work.

Frederick Isenberg blames the defendants for causing John F. Isenberg’s injuries, saying they negligently failed to keep equipment in proper repair, failed to perform repairs and welding on the equipment, failed to provide adequate warnings and failed to ensure equipment was in proper repair.

Frederick Isenberg is seeking a judgment of more than $300,000. He is being represented by R.J. Abernathy of Belleville.
