Sam's Club in O'Fallon sued over customer's slip on wet, foreign substance

 

 

A man claims he underwent back surgery after slipping and falling on the floor of a Sam’s Club store, according to a recently filed lawsuit.

David Grah filed a lawsuit April 30 in the Madison County Circuit Court against Sam’s Club and Walmart, doing business as Sam’s Club.

In his complaint, Grah alleges he was shopping at the Sam’s Club at 1350 W. Highway 50 in O’Fallon on July 3, 2012, when he slipped and fell on a wet foreign substance.

Because of his fall, Grah sustained back, neck, lower back, hip and right elbow injuries and suffered great physical pain and mental anguish, according to the complaint. He also incurred medical costs, lost wages, endured disability, lost his normal life and suffered disfigurement, the suit states.

Grah blames Sam’s Club for causing his fall, saying it failed to properly maintain its aisles and walkways, failed to perform routine and proper inspections of the aisles, failed to warn Grah of the dangerous condition of the walkway, failed to place a warning sign in the area and failed to timely clean up the slippery substance.

Grah is seeking a judgment of less than $300,000. He is being represented by Michael P. Glisson of Williamson, Webster, Falb and Glisson in Alton.
