Eden Retirement Center seeks repayment of $30K for services

A retirement center claims one of its residents failed to pay it more than $30,000 owed for his stay.

Eden Retirement Center filed a lawsuit May 1 in the Madison County Circuit Court against John P. Mersinger and John S. Mersinger Jr.

In its complaint, the retirement center alleges John P. Mersinger was a resident at its assisted living facility. He was supposed to pay a monthly fee of $2,600 in exchange for shelter, food, housekeeping services and assistance with daily living activities, according to the complaint.

The defendant failed to make the monthly payments in accordance with the contract, and, as such, the defendant owes the plaintiff the sum of $35,836.51, the suit states.

Although Eden Retirement Center has demanded the money from John P. Mersinger, he has refused to pay the costs, the complaint says.

John S. Mersinger Jr. was supposed to pay for the cost of his father’s stay at the center, but refused to do so, Eden claims.

In addition to the money it claims it is owed, the center is seeking interest at 18 percent per annum, attorneys’ fees, costs and other relief the court deems just. It is being represented by Sandra J. Tatoian of Mathis, Marifian and Richter in Edwardsville.
