A St. Clair County couple has failed to pay a construction company for work performed, according to a recently filed lawsuit.
Marsolf Construction filed a lawsuit April 30 in the St. Clair County Circuit Court against David and Bernadette Courtney.
In its complaint, Marsolf Construction alleges the Courtneys hired it for various construction services Sept. 7, 2012. However, the Courtneys have since refused and prevented Marsolf Construction from reaching final completion of the project, according to the complaint.
“Despite multiple requests in writing and in person, the Courtneys have refused and continue to refuse to pay Mansolf Construction,” the suit states. “The balance due under the Contract, exclusive of interest, is $44,618.36. The balance due for the Additional Requested Work, exclusive of interest, is $29,016.”
Marsolf Construction alleges breach of contract and unjust enrichment against the Courtneys.
In addition to the money it claims the Courtneys owe it, Marsolf Construction is seeking costs, attorney’s fees, interest and other relief the court deems just. It is being represented by Frederick J. Ludwig of Husch Blackwell in St. Louis.
