A recently filed lawsuit claims a woman endured right knee surgery after a shopping cart tipped on top of her.
Tama Sarmento filed a lawsuit April 28 in the Madison County Circuit Court against Walmart and Matt Gehrs.
In her complaint, Sarmento alleges she was attempting to return a shopping cart to a stall in the parking lot of the Walmart at 1040 Collinsville Crossing Boulevard in Collinsville on Sept. 27, 2012.
“When the plaintiff went to return the shopping cart in question, she pushed the cart into the metal strip in question, which caused the cart to flip upside down and land on top of her, thereby greatly injuring herself,” the suit states.
Because of the incident, Sarmento suffered neck, knees and back injuries, which required her to endure a right knee surgery, the complaint says. She also claims she suffered great physical pain and mental anguish, incurred medical costs, lost wages, endured disability, lost her normal life and suffered disfigurement.
She blames Walmart for causing her injuries, saying the store negligently failed to properly maintain the cart return area, failed to perform routine and proper inspections of the cart return area, failed to warn of the dangerous conditions of the cart return area, failed to place a warning sign or cone in the area where she fell, failed to repair the metal strip and failed to level the metal strip, among other negligent acts.
Sarmento is seeking a judgment of more than $50,000, plus costs. She is being represented by Michael P. Glisson of Williamson, Webster, Falb and Glisson in Alton.
