Injured worker says attorney failed to file work comp claim within statute of limitations

A man has filed suit against his former attorney, alleging he failed to file a workers’ compensation lawsuit within the three year statute of limitations.

London King filed suit April 23 in the St. Clair County Circuit Court against Jeffery Kearney.

According to the complaint, King hired the defendant on Nov. 4, 2010, to represent him in a workers’ compensation case. King intended to file a lawsuit after he was hurt working as a truck driver for Beelman Trucking on Oct. 20, 2009, according to his current complaint.

However, Kearney failed to file the lawsuit within the three year statute of limitations, resulting in King’s inability to pursue his workers’ compensation benefits, the suit states.

King is seeking a judgment of $150,000, plus other relief the court deems just. He is being represented by Eric Kirkpatrick of Kirkpatrick Law Offices in Belleville.
