Aspen Waste Systems blamed for almost hitting man; Injuries sustained jumping backwards

A St. Clair County couple is suing Aspen Waste Systems after the husband was almost hit by a trash truck.

Michael Toth and Glenda Toth filed a lawsuit April 11 in the St. Clair County Circuit Court against Aspen Waste Systems of Missouri Inc., citing negligence and loss of companionship.

The plaintiffs claim Paul J. Garrison, an employee of the defendant, was operating a trash truck at Pheasant Woods apartment complex in Belleville on May 8, 2012, when he narrowly missed hitting plaintiff Michael Toth. The suit alleges Toth was outside moving his truck when Garrison drove at a high speed in the trash truck close to Toth, making him jump backward to avoid being hit. According to the complaint, when Toth jumped backwards he struck his back on the side view mirror of his truck, causing injuries.

The plaintiffs are seeking damages in excess of $50,000 and court costs.
