A woman claims she suffered spinal injuries after she slipped on water while shopping at Walmart.
Bertha Gilkey filed a lawsuit April 3 in the St. Clair County Circuit Court against Walmart.
In her complaint, Gilkey alleges she was shopping at the O'Fallon Walmart on June 3, 2012, when she suddenly slipped and fell on water that had accumulated on the floor.
Because of her fall, Gilkey suffered bilateral lower extremities, right upper extremity, back and spine injuries, according to the complaint. She also suffered great physical pain, endured an impaired ability to work, incurred medical costs and lost wages, the suit states.
She blames Walmart for causing her injuries, saying it failed to adequately warn her of the slip hazard, failed to train its employees on the proper method to clean water on the floor, failed to properly clean the floor, failed to place mats on the floor and failed to rope off the area to warn the public of the water hazard.
Gilkey is seeking a judgment of more than $50,000, plus post-judgment interest, costs and other relief the court deems just.
She is being represented by Shaun Falvey of Brown and Crouppen in St. Louis.
