Woman says doctor misled her into believing she was suffering from ectopic pregnancy

A woman believing she was suffering from an ectopic pregnancy claims she ended the lives of her fetus twins without knowing they actually could have been born alive.


Cassandra Malloy filed suit April 4 in the Madison County Circuit Court against Christina Midkiff M.D. and Anderson Hospital.

According to the complaint, doctors administered Methotrexate after advising her she was having an ectopic pregnancy, which posed significant threats to her health. The Methotrexate caused Malloy to miscarry. It was not until Jan. 22, 2013, that Malloy discovered she actually had twin babies in utero at the time the Metotrexate was administered, according to the complaint.

“At no time did plaintiff give her consent to the termination of a uterine pregnancy or give her consent to abortion of any fetus that had any chance at being born alive,” the suit states.

Because of defendant Midkiff’s actions, Malloy suffered emotional distress, the complaint says.

She blames Midkiff for causing her distress, saying the doctor misdiagnosed her with an ectopic pregnancy, failed to diagnose her with a uterine pregnancy, improperly advised her to have Methotrexate administered and improperly prescribed Methotrexate.

Malloy is seeking a judgment of more than $100,000, plus costs.

She names Anderson Hospital as a respondent in discovery, saying she believes it has essential information related to her case.

Malloy will be represented by J. Kevin Wolfe of Harvey and Stuckel in Peoria.
