Alleged intoxication blamed for Pontoon Beach accident

A man has filed suit against the allegedly intoxicated driver he claims caused a collision.


Michael J. Carmack filed suit March 28 in the Madison County Circuit Court against Steven L. Martin.

According to the complaint, Carmack was driving a Mazca RX8 west on Lily Avenue in Pontoon Beach on April 14, 2012, when he stopped at a stop sign. Suddenly, Martin, who was driving a Ford F150 east on Lily Avenue, struck the stop sign, according to the complaint.

Due to the collision, Carmack sustained severe and permanent injuries, suffered great pain and anguish and incurred medical costs, the suit states. He also lost wages, the complaint says.

Carmack blames Martin for causing the collision, saying he negligently failed to keep a proper lookout, failed to reduce his speed to avoid a collision, failed to keep his vehicle under proper control, failed to properly follow traffic signals and drove too fast.

Carmack is seeking a judgment of more than $50,000, plus costs. He is being represented by Patrick G. Johnston and Benjamin T. Stephens of Johnston Law Offices in Edwardsville.
