Spee-Dee Courier driver claims he was fired after accident

A man who suffered from a lacerated scalp and multiple fractured bones in a 2013 collision says he lost his job after going on leave.

John Fisher filed a lawsuit March 24 in the Madison County Circuit Court against Spee-Dee Courier.

In his complaint, Fisher alleges he was working as a delivery driver for Spee-Dee on May 16 when his vehicle started to skid on wet pavement. It then left the road and rolled over, according to the complaint.

Following the collision, Fisher was taken to Pana Community Hospital where he was stabilized, then transferred to St. John’s Hospital emergency room, the suit states. He was not allowed to return to work until he was released by his doctor, Christopher Wohltmann, the complaint says.

In the meantime, Fisher had filed a workers’ compensation claim. On May 24, he was called into Spee-Dee’s office where his branch manager, Christopher Nelson, fired him, according to the complaint.

Fisher is seeking actual and compensatory damages, back pay, future lost wages, mental anguish, attorney’s fees and other relief the court deems just.

He is being represented by Kevin C. Kaufhold of Kaufhold and Associates in Belleville.

Madison County Circuit Court case number 14-L-475.
