Failure to diagnose led to kidney failure, suit claims

In a recently filed lawsuit, doctors are blamed for failing to diagnose and treat a woman’s illness before she suffered from kidney failure.


Patsy E. Cole filed a lawsuit March 26 in the Madison County Circuit Court against Dr. Jon Wagnon, Family Physicians of Godfrey, BJC Medical Group R.N., Kathy Geisler and BJC Home Care Services.

In her complaint, Cole alleges she sought treatment from Wagnon for her medical condition between January 2012 and April 4, 2013. During that time, Cole’s condition became so severe she required hospitalization at Alton Memorial Hospital, according to the complaint. She suffered from kidney failure, the suit states.

Because of her condition, Cole suffered pain and permanent disability, lost her normal life and endured emotional distress, the complaint says. She also claims she incurred medical costs.

She blames Wagnon for causing her injuries, saying he negligently failed to diagnose her with her illness and failed to treat her medical condition.

She also names Geisler and her employer BJC Home Care Services as defendants, saying Geisler negligently failed to observe Cole’s medical condition, failed to record the symptoms of her medical condition, failed to report the symptoms of her medical condition and failed to properly treat her medical condition.

Cole is seeking a judgment of more than $250,000, plus costs. She is being represented by B. Jay Dowling of the Law Offices of Sterling and Dowling in Fairview Heights.
