Driver accused of failing to brake at busy Edwardsville intersection

A man claims he sustained neck and lower back injuries after a driver struck the side of his vehicle.

Kyle Greenwell filed a lawsuit March 17 in the Madison County Circuit Court against Ricky Biethman.

In his complaint, Greenwell alleges he was driving west on Governor’s Parkway in Edwardsville on June 1, when Biethman, who was driving south on Illinois Route 157, struck the side of Greenwell’s vehicle.

In addition to his injuries, Greenwell became sick, sore, lame, disordered and disabled, incurred medical costs and suffered disability because of the accident, the suit states. He also experienced pain and suffering and lost wages, the complaint says.

Greenwell blames Biethman for causing the collision, saying he negligently failed to keep a proper lookout, drove in such a manner so as to strike the side of Greenwell’s vehicle, failed to properly apply his brakes, drove too fast and failed to yield the right-of-way.

Greenwell is seeking damages in excess of $50,000. He is being represented by Thomas C. Rich, Kristina D. Cooksey and Michelle M. Rich of Fairview Heights.

Madison County Circuit Court case number 14-L-425.
