Bank accuses couple of failing to pay off more than $50,000 worth of debt

A bank claims a couple failed to repay more than $50,000 owed under their credit card.


Capital One Bank filed a lawsuit March 11 in the Madison County Circuit Court against Geoffrey L. Goetz and Marcia K. Goetz.

In its complaint, Capital One alleges the Goetzes opened a credit card account and promised to repay any balances on it. Since then, however, they have failed to make their required payments, according to the complaint.

“After allowing for all credits due defendant, there is due and owing as of Feb. 21, the sum of $55,690.66,” the suit states.

In addition to the money it claims the Goetzes owe it, Capital One is seeking court costs. It is being represented by Jerome E. Riley, Michael Polk, Clay Mosberg and Mary Spitz of Freedman, Anselmo and Lindberg in Naperville.
