Fast Eddie's sued over customer's trip on curb

A Madison County woman claims she suffered severe injuries to her right leg and hip after she tripped on a curb.

Cleda Chesnut and George Chesnut filed a lawsuit March 13 in the Madison County Circuit Court against Fast Eddie’s Bon Air.

In their complaint, the Chesnuts allege Cleda Chesnut was at Fast Eddie’s on Sept. 29 and was using a shopping cart when she tripped on a curb.

In addition to her injuries, Cleda Chesnut incurred medical costs, experienced great pain and mental anguish and suffered permanent scarring, according to the complaint. She also lost her normal life, the suit states.

George Chesnut claims he lost his wife’s support and services following the fall and incurred medical costs.

The Chesnuts blame Fast Eddie’s for causing the fall, saying it negligently failed to provide a safe walkway, failed to properly mark curbs or provide ramps from the pavement to the sidewalk and failed to warn of the dangerous condition.

The Chesnuts are seeking a judgment of more than $100,000, plus costs. They are being represented by Brian M. Wendler and Ellen Burford of Wendler Law in Edwardsville.

Madison County Circuit Court case number 14-L-403.
