Troy Jack-in-the-Box sued over customer's slip in bathroom

A woman blames restaurant employees for causing her to fall on a wet, slippery floor.


Rose Stark filed a lawsuit March 8 in Madison County Circuit Court against Jack in the Box, Illinois Jack and an employee mentioned only as John Doe.

In her complaint, Stark claims she was eating at the Jack in the Box at 830 Edwardsville Road in Troy on March 20, 2012, when she attempted to use the restroom.

“As the plaintiff Rose Stark was inside a bathroom, she was caused to slip and fall on the floor sustaining severe and permanent injuries,” the suit states.

Because of her fall, Stark was hindered from attending to her usual duties and affairs, lost value of her time and suffered great pain and anguish, the complaint says. She also claims she incurred substantial medical costs.

Stark blames Jack in the Box and its employee for causing her fall, saying they improperly managed its premises, failed to warn her of the dangerous condition in the restroom, failed to make a reasonable inspection of its premises and allowed the premises to remain in a dangerously slippery condition.

Stark is seeking a judgment of more than $150,000, plus other relief the court deems just. She is being represented by Warren Danz of the Law Offices of Warren Danz in Peoria.
